General Terms and Conditions of Sale Lexibook.com

 

Scope of the general terms and conditions

Lexibook SA, with registered office at 6 Avenue des Andes, building 11, 91940 Les Ulis, France, capital of 3,412,909.50 euros, registration number 323 036 921 RCS Evry, tel.: 01 73 23 23 23 23 (hereinafter referred to as the Company) offers for sale, through its website www.lexibook.com (hereinafter referred to as the Site), a range of products and services aimed at retail customers. 

These terms and conditions apply to all sales made by the Company through its website, excluding any other conditions. These general terms and conditions of sale aim to define the terms of sale between the Company Lexibook SA and the consumer, from the order to services, through payment and delivery. 

They settle all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.

 

Products

Lexibook designs, manufactures and markets consumer electronics products as well as educational and electronic toys. 

Through its Lexibook.com online store, the company sells items, products and services relating to office automation, including calculators, electronic dictionaries, electronic translators and PDAs, multimedia, sound, image and microcomputing, home equipment, with home telephony and clock products such as alarm clocks and clock radios, thermometers and weather stations, and edutainment toys, with early-learning games, educational computers for children, board games, interactive electronic toys and imitation games. 

The essential characteristics of the products are described in the product sheets. Lexibook expressly reserves the right at any time to add new products, to remove all or part of the products sold or presented in the Site catalogue, to change their presentation or to cease marketing them on its Site, without being obliged to give prior notice to the customer. 

Our product offers and prices are valid as long as they are visible on the Site, subject to availability.

On receipt of your order, we will check the availability of the product(s) ordered. In the event of unavailability, we undertake, within 30 days of validation of the order, either to deliver the product ordered or to reimburse you for it. 

If one of the products in your order is out of stock, we will inform you immediately by e-mail or telephone and we will dispatch the rest of your order, with an information message on the preparation slip.

 

Orders

In accordance with the law of 13 March 2000 on electronic signatures, any order validated by the consumer with a ‘double click’ to accept the general terms and conditions of sale and to validate the order basket constitutes an irrevocable acceptance which can only be challenged within the limits set out in these general terms and conditions of sale in the same way as the ‘right of withdrawal’ and ‘out of stock’.

Furthermore, the order can only be registered on the site if the Customer has clearly identified him/herself by entering his/her identifier (e-mail address) and password. The Customer undertakes to ensure that the information provided to the Company is complete, accurate and up to date. In the event of incomplete or inaccurate information, the Company reserves the right to cancel the order and payment outright. In accordance with the French Data Protection Act of 6 January 1978, Customers have the right to access, modify, rectify and delete any personal data concerning them. To exercise this right, he/she simply needs to send an e-mail to: savcomfr@lexibook.com or a letter to Lexibook SA - Service Vente en ligne - 6 Avenue des Andes, Bâtiment 11, 91940 Les Ulis, France. 

The Customer must check all the information entered during his Order (product ordered and quantity, delivery address, invoicing address, telephone number, etc.). This information is recapitulated on the confirmation e-mail sent to the Customer as soon as the order is received by Lexibook's online sales department. 

If an anomaly is found, the Customer must contact the customer service within 24 hours of receiving the confirmation e-mail, by e-mail at the following address savcomfr@lexibook.com.   

Lexibook cannot be held responsible for any data entry errors made by the Customer or for the consequences of such errors in terms of late or incorrect delivery. Thus, if delivery cannot take place due to an error in the Customer's data entry, the costs of re-shipment will be borne by the Customer. In this case, the Customer shall refrain from making any claims due to delivery delays.

 

Order modification 

Once the order has been validated, the Customer will not be able to modify it. It will be possible to request cancellation of the order by contacting the after-sales service here. 

 

Prices and billing

4A/ Prices and Promotions 

The products and services sold on Lexibook.com are reserved for private individuals. The prices of our products are indicated in euros all taxes included eco-participation included except share in the expenses of treatment and forwarding. Lexibook.com reserves the right to change prices at any time but products will be charged based on rates in effect at the time of validation of the order. The Customer may also benefit, during certain periods, from promotional offers on certain products. These offers will be announced online on the Site and will be valid during the indicated period and always within the limit of available stocks. The products remain the property of Lexibook SA until the total amount of the order has been paid in full.

 

4B/ Invoicing

An invoice is issued for each delivery and is available from the customer account created when the order was placed. Any complaints regarding invoices must be notified to the Company by e-mail within 10 days of receipt to savcomfr@lexibook.com. Failing this, invoices are deemed to have been accepted without reservation. Incomplete delivery of an order may not justify refusal to pay for the products delivered. Any dispute between the Customer and the Company shall under no circumstances constitute grounds for suspension of payment of the undisputed part of the invoice.

 

Terms and conditions of payment

5A/ Secure online payment by credit card 

On Lexibook.com, online payment is totally secure by a server operating in SSL mode (128 bits) and thanks to the Stripe software online payment solution, you are guaranteed to pay for your purchases in complete confidence on our site. 

Our site accepts Visa, Mastercard, American Express, Discover, Diners Club, JCB, UnionPay and French bank cards.

You enter the card number, expiry date and cardholder's name. For even greater security, you also enter the card's control number: the last 3 digits of the number on the back, near the signature. 

All your bank transactions are carried out on Stripe's secure servers: neither Lexibook nor any other Internet user has access to your bank details. Similarly, Stripe does not know the details of your purchases. Your privacy is totally preserved.

 

Delivery

Order preparation time: 

The Company will make every effort to process orders within 24 to 48 hours of confirmation of payment. 

Deliveries are only made subject to availability and on a first come, first served basis. In the event of one of the products ordered being out of stock, the Company will inform the Customer of the new availability of the products and will proceed with partial delivery of the order unless the Customer gives immediate instructions to the contrary. 

In addition to this preparation time, the delivery time is 48 to 72 hours for delivery in mainland France, depending on the department. 

All our deliveries are made by carrier from Monday to Friday, except public holidays. 

Delivery takes effect when the products are collected by the carrier, who will deliver the order to the delivery address given by the Customer on the order form and hand over the delivery note. 

We deliver to Metropolitan France. However, we do not deliver to the following countries: Canary Islands, Melilla, Ceuta, Gibraltar, Andorra, Balearic Islands, Sardinia, Sicily, Azores, Madeira, Guernsey, Isle of Man, Jersey, Shetland Islands.

In the event of exceptional stock shortages, the customer will be informed by e-mail. They may then request a partial delivery, and a later dispatch of the item(s) concerned or request a refund of the sum of the undelivered products.

 

Returns / Exchanges / Refunds

7A/ Right of withdrawal 

Lexibook undertakes to refund the product if the request is made within 14 working days of delivery.

The product must be returned in its original packaging complete (product, instructions, accessories etc..) and be in perfect condition, accompanied by the invoice. The cost of returning the product is borne by the Customer. No refund will be issued upon receipt of a damaged product.

By common law, goods travel at the Customer's risk. In this respect, the Company advises the Client to take all appropriate guarantees and measures to cover this risk and ensure optimum protection of the product. 

The Company reserves the right to refuse any return that does not comply with the above conditions. 

No refund will be issued on receipt of a damaged product if the Company has not been informed of this condition beforehand. 

If the product is not exchanged, the product and the shipping costs initially invoiced will be reimbursed in full.

 

7B/ Breakdown on unpacking - incorrect delivery & defective products under guarantee 

If a problem occurs with the product and it is still under guarantee, the Customer must contact the After-Sales Service by filling in the contact form available in the ‘Contact’ section, then ‘After-Sales Service’. 

In accordance with articles L 211-4 et seq. of the French Consumer Code, the Customer benefits from a guarantee allowing him/her to return defective items delivered.

In accordance with articles 1641 to 1649 of the French Civil Code, the Customer has the right to return the product if a hidden defect is found or if the product is defective.

  • Breakdowns on unpacking and incorrect receipt

A request for a return must be made to our customer service department within 15 days of delivery.

In the event of a fault on unpacking or delivery that does not conform to the order, the Company will send a returns label to collect the product.

The product must be returned in its original packaging (product, instructions, accessories, etc.), accompanied by the invoice or delivery note.

  • Breakdown under warranty

A return request must be made on our RMA portal within 2 years under the warranty. If the fault is found by our after-sales service, Lexibook will exchange the product. In case of impossibility, the product will be refunded.

The product must be returned with all its accessories (remote control, cable, etc.) together with the returns number visible on the parcel.

 

7C) Out-of-warranty breakdown 

Any appliance that breaks down after the 24-month guarantee period (according to the duration indicated in the instructions for use) or that is excluded from the guarantee will be considered to have broken down outside the guarantee. Beyond the 24-month guarantee period following the date of purchase, products may be repaired or exchanged, subject to quotation.

Guarantees

The products sold by Lexibook SA are covered by a contractual guarantee of 24 months (subject to legislative changes), from the date of purchase of the product by the end user, except for telephony products and MFC laptops and accessories (guarantee of 12 months only). 

Only Lexibook brand products and accessories are included in this warranty. 

Rechargeable batteries for Lexibook products are only guaranteed for 6 months. 

This warranty covers material or assembly defects attributable to the manufacturer to the exclusion of any deterioration resulting from non-compliance with the instructions for use or any untimely intervention on the product (such as dismantling, exposure to heat or humidity, etc.).

 

Cases of exclusion from the guarantee 

The contractual guarantee does not cover the repair of Lexibook products if the returned products present one of the following characteristics: 

- The serial, batch or IMEI number of the product is obscured or removed, 

- Absence or falsification of the proof of purchase, 

- Modification or dismantling of the product by persons not qualified or not approved by Lexibook, 

- Product blocked due to forgotten password (tablet or phone in particular), 

- Broken screen or display, 

- Damage caused by impact and/or dropping of the product, 

- Product received broken due to insufficient packaging protection, 

- Defect or failure due to misuse, negligence or accidental cause,

 

Electrical and electronic equipment: 

We inform you that the presence of hazardous substances in electrical and electronic equipment can have potential effects on the human environment and health. So, you should not dispose of them with unsorted municipal waste. That is why Lexibook is a member of ERP, an organisation that collects used electronic products. To find out more, click here.

Personal data

This site has been declared to the CNIL under number 1335627. 

All the information collected by www.lexibook.com from the Customer is subject to computer processing intended for the processing of the online order and subsequent contractual obligations, such as guarantees. It may be used for commercial canvassing and promotional communication linked exclusively to the activities of the company Lexibook and be transmitted to the service providers of the company Lexibook or to any administrative or judicial authority that may request it, with the express authorisation of the Customer. 

In accordance with the French Data Protection Act n°78-17 of 06 January 1978, the Customer may at any time access personal information concerning him/her and held by www.lexibook.com and request its modification or deletion by sending an e-mail to savcomfr@lexibook.com or by post to the following address: Lexibook SA - Service Internet, 6 Avenue des Andes, Bâtiment 11, 91940 Les Ulis. Thus, the Customer may irrevocably request that any information concerning him/her that is inaccurate, incomplete, ambiguous, out of date or whose collection, use, communication or storage is prohibited be rectified, completed, clarified, updated or deleted.

To get to know the customer better and to provide him with information tailored to his needs, Lexibook may collect personal information by using cookies. The Customer may oppose this by deactivating this function. To do so, please consult our ‘legal notice’.

Intellectual property rights

All the visual and audio elements that make up the www.lexibook.com website, whether text, content, comments, illustrations, images, photographs or videos, including the underlying technology, are protected by copyright, trademarks or patents. 

They are the exclusive property of the www.lexibook.com website. 

Any total or partial reproduction of the www.lexibook.com site is strictly prohibited. Users who have a personal website and who wish to place a link on their site for personal use, linking directly to the home page of the www.lexibook.com site, must request authorisation from the Lexibook company. Any link must be removed on simple request from the company Lexibook.

Disputes

These general conditions of sale and the online sales contract are subject to French law. 

Any dispute relating to the interpretation, performance or breach of contract between the company Lexibook and the Customer, even in case of recourse in warranty or multiple defendants, will in the absence of amicable agreement, the exclusive jurisdiction of the French courts.

In accordance with the Consumer Code, the consumer Customer within the meaning of the Consumer Code, may, in the event of a dispute, have recourse free of charge to the mediation service for consumer disputes: by electronic means: www.medicys.fr or by post to the following address: MEDICYS - Centre de médiation et règlement amiable des huissiers de justice - 73, Boulevard de Clichy, 75009 - Paris.

However, any consumer dispute must be referred to Customer Services in writing before any request for mediation. Referral to the mediator must be made within one year of the Customer's written complaint to the Vendor.

Customer acceptance

The above general terms and conditions of sale and the price list are expressly approved and accepted by the customer, who declares and acknowledges that he/she is fully aware of them. The Customer hereby waives the right to invoke any contradictory document, in particular the Customer's own general terms and conditions of purchase. The act of purchasing implies acceptance of these general terms and conditions of sale. 

If any of the provisions of these Terms and Conditions of Lexibook.com is declared void in whole or in part, the other provisions and other rights and obligations arising from these Terms and Conditions remain unchanged and remain applicable. 

The updated version of the General Conditions of Sale of Lexibook.com is constantly accessible online by the Customer.
